This directive:
  • A.informs Department members of the Illinois Uniform Conviction Information Act (IUCIA), (20 ILCS 2635/1, et seq.).
  • B.outlines the procedure for referring requests for conviction information.
II.General Information
  • A.Pursuant to the Illinois Uniform Conviction Information Act, Illinois Compiled Statutes, Section 2635/5, "...All conviction information mandated by statute to be collected and maintained by the Department of State Police shall be open to public inspection in the State of Illinois. All persons, state agencies and units of local government shall have access to inspect, examine and reproduce such information, in accordance with this Act, and shall have the right to take memoranda and abstracts concerning such information, except to the extent that the provisions of this Act or other Illinois statutes might create specific restrictions on the use or disclosure of such information."
  • B."The provisions of this Act shall not apply to statistical information" (20 ILCS 2635/4(B)).
  • C.Definitions are contained in 20 ILCS 2635/3.
III.Rerferral Procedure
  • A.A requester for conviction information maintained by the Illinois State Police will be referred to  Illinois State Police, Division of Administration, Bureau of Identification .
  • B.A sworn member requesting conviction information maintained by the Illinois State Police Department will follow procedures outlined in the Department directive entitled "Computerized Criminal History (CCH)".
