Illinois Department of Corrections – Parolee Violation Warrant Interview

This directive informs Department members that:
  • A.arresting officers may be directed to telephonically contact Illinois Department of Corrections (IDOC) parole agents within a few days after an arrest of a parolee to discuss the arrest incident.
  • B.the notice to contact the IDOC parole agent will be made via the electronic Court Notification Program.
II.General Information
  • A.The IDOC is under a federal consent decree which mandates that all parolees, who are violated in Cook County which results in the issuance of a parole violation warrant issued by the IDOC, will receive a preliminary hearing investigation soon after filing the violation warrant at the Cook County Jail or the IDOC Northern Reception Center at the Stateville institution.
  • B.To satisfy this legal requirement, the IDOC parole agent must telephonically interview the arresting officer concerning the arrest. Failure to conduct this interview will result in an automatic finding of no probable cause, a withdrawal of the IDOC warrant, and the parolee may be eligible for an I-bond or turned over to Cook County Department of Corrections.
  • C.This interview enables the IDOC to return violent recidivist offenders to the Illinois penitentiary system. Arresting officers will cooperate with this request. Department members will not be required to appear at any special court hearing other than what is already established for the arrestee.
  • A.Watch commanders will:
    • 1.notify the named officer(s) as listed in the Court Notification Program. In the event that:
      • a.there is more than one officer listed on the notification form only one of the arresting officers needs to make the call.
      • b.the officer(s) is not available to contact the IDOC parole agent within the specified time parameters, the watch commander from the 2nd watch will assign the desk sergeant to call the parole agent to explain the officer(s) unavailability. The Notification of Court Absence (CPD-11.560) will be used to record the date and time this call was made.
    • 2.authorize call-back overtime, when necessary, to ensure the officer contacts the parole agent in a timely manner.
  • B.The notified arresting officer(s) will telephonically contact the requesting IDOC parole agent:
    • 1.within 48 hours as indicated via the notification at the telephone number provided.
    • 2.between the hours of 0700 - 1600 hours. All efforts will be made by the notified officer to make this call during duty hours unless the 48 hour window cannot be satisfied.
      • a.In the event that the arresting officer(s) does not reach the parole agent on the first call, the officer(s) will leave a voice mail message for the IDOC agent with sufficient contact information for the parole agent to return the call. Officers unable to speak directly with the parole agent after two unsuccessful attempts will contact the on-duty desk sergeant and have this information recorded in the Notification of Court Absence booklet.
      • b.This telephone number may or may not be an IDOC office number; it may be a cellular phone assigned to the IDOC parole agent.
