Potential Cost Recovery Incidents - City of Chicago

This directive:
  • A.establishes procedures to facilitate the initial identification of any incident where the City of Chicago or the Department has incurred expenses and has an opportunity to recover its cost relative to personnel and equipment use or damaged property.
  • B.continues the Cost Recovery Incident Form (CPD-61.230).
II.General Information
  • A.Chapter 1 - 20 of the Municipal Code of Chicago (MCC) authorizes the City to seek financial compensation (including the recovery of court costs and attorney fees) for the wages and benefits of City personnel, the reasonable costs of equipment and materials, and any other costs allocable to the provision of services that are the result of any person’s violation of any federal, state, or local law.
  • B.Examples of potential cost recovery incidents include, but are not limited to:
    • 1.the deployment of police to respond and provide service as a result of a person’s false reporting of a crime, e.g., false bomb and fire reports.
    • 2.major police-service levels from specialized units, e.g., SWAT deployment for hostage, barricaded, or terrorist incidents.
    • 3.violation of any law or ordinance, even if the offense was committed before, during or after a civil demonstration or protest.
    • resulting in the delivery of lengthy traffic control services due to fires, hazardous materials, motor vehicle crashes, trucks hitting viaducts, unsafe building conditions, and other similar events due to a possible law or ordinance violation.
      Department members will NOT submit the Cost Recovery Incident Form (CPD-61.230) for Department vehicle traffic crashes or any other incidents resulting in the City of Chicago to be listed in the Damaged Properties field of the Illinois Traffic Crash Report.
    • 5.organized, but not legally sanctioned events (i.e., without permits), for which the Department must increase staffing levels or provide other than customary service.
    • 6.quality of life offenses such as graffiti or damage to property.
    • 7.court appearances when Department members are notified or subpoenaed to appear in court, as a result of cost recovery incidents.
    • 8.incident(s)/event(s) resulting in the response of six or more City vehicles.
  • A.Preliminary investigators, follow-up investigators, and supervisors will recommend events for cost recovery consideration such as personnel, equipment, or damaged property by:
    • 1.completing a Cost Recovery Incident Form (CPD-61.230).
    • 2.attaching copies of the supporting documents (e.g., PCAD printout for event, Arrest Report, Case Report, or a To-From-Subject Report) to the member's station supervisor/designated unit supervisor describing the incident.
    • 3.tracking all court time resulting from this cost recovery incident.
    • 4.submitting the Cost Recovery Incident Form and supporting documents to the station supervisor/designated unit supervisor.
  • B.Station Supervisors or designated unit supervisors will:
    • and, if appropriate, approve all documents.
      The reviewing supervisor will ensure the incident is NOT a Department vehicle traffic crash or any other incident resulting in the City of Chicago to be listed in the Damaged Properties field of the Illinois Traffic Crash Report.
    • 2.forward the original cost recovery package to the Director, Finance Division.
    • 3.forward a copy of the cost recovery package to the unit commanding officer.
  • C.Records Division will forward information from Department vehicle traffic crashes and any other incidents resulting in the City of Chicago to be listed in the Damaged Properties field of the Illinois Traffic Crash Report directly to the City of Chicago Department of Finance.
  • D.The Director, Finance Division, will:
    • 1.gather, coordinate, and solicit supplemental investigative reports and personnel assignments to complete the package.
    • 2.submit the completed package and relevant reports to the Department of Revenue or Law, as appropriate, in the manner and format identified by these departments.
