Procedures for Responding to Requests for Asylum by Foreign Mission Personnel or Foreign Nationals

I.Purpose
This directive establishes procedures for responding to requests for asylum by foreign mission personnel or foreign nationals.
II.Request for Asylum
  • A.Upon receipt of a request for asylum from a foreign national or a member of a foreign mission, a Department member will immediately notify the station supervisor.
  • B.The station supervisor will ensure that an Information Report (CPD-11.461) is completed and the Crime Prevention and Information Center (CPIC) is immediately notified. The following information will be provided, when available:
    • 1.The name and nationality of the individual seeking asylum.
    • 2.The date and place of birth.
    • 3.Occupation.
    • 4.A description of any documents presented.
    • 5.The names of any consular officials aware of the individuals intention to seek asylum.
    • 6.The exact location of the person seeking asylum. If the individual is aboard a vessel or an aircraft, the estimated time of arrival at the next intended port or airport will be included in the report.
    • 7.The reason for claiming asylum.
    • 8.A description of any criminal charges known or alleged to be pending against the person seeking asylum.
  • C.CPIC will:
    • 1.immediately notify the US Department of State and provide the information listed in Item-II-B.
    • 2.contact the Immigration and Naturalization Service (INS), Department of Justice. The INS will evaluate each case individually and arrange for a case transfer when appropriate.
  • D.Protective custody will be provided to the person requesting asylum until the appropriate United States Government officials assume custody.
  • E.Inquiries from consular officials will be directed to the United States Department of State, Washington, DC.
