Traffic Crashes - Damage To Governmental Property

I.Purpose
This directive informs Department members of procedures for completing the Illinois Traffic Crash Report when a traffic crash involves the property of any governmental agency.
II.General Information
  • A.In all traffic crashes involving damage to public property, the investigating member will complete the Damaged Properties field of the Illinois Traffic Crash Report indicating the owner as the applicable governmental agency (e.g. City of Chicago, Chicago Park District, Chicago Police Department, State of Illinois, etc.).
  • B.The Municipal Code of Chicago (MCC) Section 8-4-120 states, “No person shall cut, injure, mark, or deface any public building, sewer, water pipe, hydrant, or other city property, fixture or personal property, or any tree, grass, shrub, or walk in any public way or public park.”
  • C.When the damage involves City of Chicago property (as defined in Item II-B) and such damage is a result of a traffic law violation, members will issue a Personal Service Citation for the traffic law violation.
    NOTE:
    Department members will NOT issue a Personal Service Citation or an Administrative Notice of Violation (ANOV) for damage to City of Chicago property (MCC 8-4-120 or (720 ILCS 5/21-1.01). Members will follow procedures outlined in the Department directive entitled Damage to Public Property to enforce MCC 8-4-120:Damage to Public Property and 720 ILCS 5/21-1.01 : Criminal Damage to Government Supported Property.
  • D.When damage involves another governmental entity’s property (e.g. State, Federal, etc.) and such damage is a result of a traffic law violation, Department members will cite the appropriate charge for the traffic violation and note the name of the other governmental agency in the complainant/witness box of the Personal Service Citation.
    NOTE:
    Department members will NOT submit the Cost Recovery Incident Form (CPD-61.230) for Department vehicle traffic crashes or any incidents resulting in the City of Chicago to be listed in the Damaged Properties field of the Illinois Traffic Crash Report . Members will not submit the Cost Recovery Incident Form (CPD-61-230) for another governmental entity's property.
