Department Members Summoned to Jury Duty

I.Purpose
This directive:
  • A.continues procedures for all Department members summoned to jury duty.
  • B.defines the responsibilities of members in receipt of a Circuit Court of Cook County form titled "Summons To Appear For Jury Service."
  • C.describes payroll and timekeeping procedures in conjunction with jury duty.
II.General Information and Requirements
  • A.Members assigned to the 2nd watch will be excused from their regular duty assignment for the period of time necessary to fulfill their jury duty responsibility in response to a summons issued by a judge of the Circuit Court of Cook County.
  • B.A Summons To Appear For Jury Service is normally sent to the person named on the summons via U.S. Mail approximately four weeks prior to the scheduled date of jury service.
  • C.For purposes of this directive, there are two types of jury duty: regular and standby.
    • 1.Regular jury duty requires the person named on the summons to report to a designated court location for jury duty on the specified date.
    • 2.Standby jury duty required the person named on the summons to call a designated telephone number after 1600 hours on the day before the jury duty date to ascertain if it is necessary for the named person to report for jury duty.
  • D.When a member in receipt of a Summons To Appear For Jury Service on a standby basis is subsequently notified in accordance with the directions on the summons that the member is not required for regular jury duty, the member will report for the next regularly scheduled tour of duty in the unit of assignment/detail. The member will notify the station supervisor/designated unit supervisor at least one hour prior to their scheduled reporting time.
  • E.When a member in receipt of a Summons To Appear For Jury Service on a standby basis is notified that the member is required to appear for regular jury duty, the member will be required to notify the station supervisor/designated unit supervisor at least one hour prior to their scheduled reporting time when assigned to:
    • 1.the 2nd watch, or
    • 2.the 1st or 3rd watch and the member requests to be excused for jury duty.
  • F.When a member requests a postponement of the scheduled date of jury duty due to a pending court case or subpoena for the scheduled date, the member will notify jury administration at the phone number provided on the Summons To Appear For Jury Service.
  • G.When unforeseen emergency circumstances arise, e.g., member on medical roll, late arrest requiring court appearance, which prevent a member from complying with the provisions of the summons, the member will notify the station supervisor/designated unit supervisor who will telephonically notify the Jury Supervisor of the member's inability to report for jury duty due to the cited emergency. This notification will also be noted in the Notification of Court Absence (CPD-11.560) by the station supervisor/designated unit supervisor.
  • H.When a member requests a postponement in a scheduled jury duty service for a reason other than relating to Department operations (e.g., scheduled furlough), the member will contact the Jury Administration in the same manner as any citizen and request a postponement.
  • I.Once a member is selected to serve on a jury, jury duty will take precedence over any other court appearance responsibilities including subpoenas for the duration of the trial in which the member is assigned as a juror.
  • J.When a member is selected for jury duty, the following provisions relating to payroll and timekeeping will apply:
    • 1.Regularly scheduled days off that occur during the period of jury services will not be changed or credited as overtime.
    • 2.Scheduled full furlough or split furlough segments will not be changed for the period of time in which the member serves as a juror.
  • K.A member who has court cases scheduled during the period the member is serving as a juror will comply with the provisions of the Department directive entitled "Court Attendance and Responsibilities" concerning court appearance responsibilities.
  • L.A member being carried injured on duty or on the medical roll during the period of assignment as a juror will be responsible for turning in all checks received from the Jury Administration to the Finance Division.
III.Procedures
  • A.A member assigned to the 2nd watch and scheduled for jury duty will:
    • 1.submit a photocopy of the Summons To Appear For Jury Service to the member's station supervisor/designated unit supervisor.
    • 2.be relieved of regular duty assignment for jury duty.
  • B.A member assigned to the 2nd watch serving on jury duty will:
    • 1.be carried Code 88 (Jury Duty) on the Attendance and Assignment Record (CPD-11.605) for the entire tour of duty for all regular duty days while assigned to jury duty regardless of the number of hours (more or less than eight) that the member is assigned to jury duty.
    • 2.endorse each jury duty check in the following manner "FOR DEPOSIT ONLY-CHICAGO POLICE DEPARTMENT" - and sign each check received for jury service performed on a regular duty day and submit such checks to the member's station supervisor/designated unit supervisor who will forward them to the unit timekeeper.
    • 3.receive a receipt from the Finance Division for all submitted jury duty checks.
    • 4.retain each jury duty check received for jury duty for nonduty days, i.e., regular day off, day off-holiday, compensatory time, personal day, furlough day, or baby furlough day.
    • 5.receive their salary for the period of time in which the member was assigned to jury duty after complying with the provisions enumerated above.
    • 6.revert to the member's regular duty assignment when not on jury duty.
  • C.A member assigned to the 1st or 3rd watch and scheduled for jury duty who does not request to be excused from the member's regular duty assignment will retain each jury duty check received for jury duty performed on regular duty days and nonduty days.
  • D.A member assigned to either the 1st or 3rd watch who requests to be excused by the member's station supervisor/designated unit supervisor from the member's regular duty assignment to facilitate reporting for jury duty will:
    • 1.at the discretion of the member's station supervisor/designated unit supervisor, be excused from their regular duty assignment for jury duty.
    • 2.be carried Code 88 (Jury Duty) on the Attendance and Assignment Record for the entire tour of duty for all regular duty days while assigned to jury duty.
    • 3.endorse each jury duty check in the following manner "FOR DEPOSIT ONLY-CHICAGO POLICE DEPARTMENT" - and sign each check received for jury duty performed on a regular duty day and submit such checks to the member's station supervisor/designated unit supervisor who will forward them to the unit timekeeper.
    • 4.receive a receipt from the Finance Division for all submitted jury duty checks.
    • 5.retain each jury duty check received for jury duty service on nonduty days, i.e., regular day off, day off-holiday, compensatory time, personal day, furlough day or baby furlough day.
    • 6.receive their salary for the period of time in which the member was assigned to jury duty after complying with the provisions enumerated above.
    • 7.revert to the member's regular duty assignment when not on jury duty.
  • E.The station supervisor/designated unit supervisor of a member assigned to the 2nd Watch and scheduled for jury duty or assigned to the 3rd or 1st watch requesting to be excused for jury duty will be responsible for the following:
    • 1.reviewing the copy of the Summons To Appear For Jury Service submitted by the affected member.
    • 2.relieving the affected member from their regular duty assignment for jury duty.
    • 3.authorizing that such member be carried Code 88 (Jury Duty) on the Attendance and Assignment Record for all regular duty days while assigned to jury duty.
    • 4.forwarding the submitted jury duty checks to the unit timekeeper.
    • 5.requesting that the unit secretary photocopy the Summons to Appear For Jury Service in those instances wherein an affected member has a pending court case, subpoena, etc., on the date scheduled for jury duty and has requested a postponement in the member's scheduled date for jury duty .
    • 6.ensuring that the affected member reverts to their regular assignment on their next scheduled duty day when not on jury duty.
  • F.The station supervisor/designated unit supervisor of a member assigned to the 1st or 3rd watch who has chosen to continue working on the 1st or 3rd watch in addition to fulfilling the member's jury duty responsibility may at the discretion of the station supervisor/designated unit supervisor be permitted the use of compensatory time to facilitate attendance at jury duty at the conclusion of the 1st watch or at the beginning of the 3rd watch.
  • G.The unit timekeeper of a member scheduled for jury duty on a date wherein the affected member was carried excused on a regular duty day will:
    • 1.verify that the member received a jury duty check for each day the member was so excused.
    • 2.forward on a daily basis the jury duty checks received from the station supervisor/designated unit supervisor to the Director, Finance Division, by submitting a To-Form-Subject report listing the payees and the check numbers of the submitted checks.
  • H.The Director, Finance Division, will be responsible for providing a receipt to the member named on the jury duty check.
