No Smoking Policy

This directive:
  • A.delineates the Department’s policy of a smoke-free workplace.
  • B.informs Department members of selected sections of the Municipal Code of Chicago, Chapter 7-32, Chicago Clean Indoor Air Ordinance of 2005 (Smoking Ban), effective 16 January 2006.
  • C.outlines Department members’ responsibilities.
The Department is committed to providing a healthful, comfortable, and productive work environment for all employees. Smoking has proved to be dangerous and damaging, not only to the smoker’s health, but also to nonsmokers who breathe “secondary” smoke. It is the policy of the Department that smoking shall be prohibited in any Department facility or vehicle by anyone.

Department members who are interested in quitting smoking can contact the Department’s Employee Assistance Program (EAP) for a list of resources.
IV.Selected Sections of Municipal Code of Chicago, Chapter 7-32
  • A.Chapter 7-32-040, City-owned Facilities
    All enclosed vehicles and facilities, including without limitation, buildings and vehicles owned, leased, or operated by the City of Chicago, shall be subject to the provisions of Chapter 7-32.
  • B.Chapter 7-32-050, Prohibition of Smoking in Public Places
    Smoking shall be prohibited in all enclosed public places and places of employment within the City of Chicago, including without limitation, the following places:
    • 1.Public transportation facilities under the authority of government agencies, including without limitation, buses, trains, taxicabs, and limousines, and ticket, boarding and waiting areas of public transit stations.
    • 2.Government vehicles used for City business such as maintenance trucks or fleet vehicles.
  • C.Chapter 7-32-070, Reasonable Distance
    Smoking is prohibited within fifteen feet of any entrance to an enclosed area in which smoking is prohibited.
  • D.Chapter 7-32-120(A), Enforcement
    Chapter 7-32 shall be enforced by the Chicago Department of Public Health and the Department of Business Affairs and Licensing, or their authorized designees.
  • E.Chapter 7-32-130(A), Violations and Penalties
    A person who smokes in an area where smoking is prohibited shall be guilty of an infraction, punishable by a fine not more than one hundred dollars ($100).
  • A.Department supervisors will ensure that the provisions of this directive are followed. Any Department member who violates this directive will be admonished and counseled by a Department supervisor using persuasion and warning to seek compliance with the ordinance. The Department supervisor will only resort to Summary Punishment or the Complaint Register process when corrective compliance measures have failed.
  • B.The Inspection Division will be responsible for monitoring Department-wide compliance to the policy and provisions in this directive.
  • C.The City of Chicago, Department of General Services, will be responsible for posting and maintaining appropriate “No Smoking” signs in Department facilities.
