I.Purpose
This directive:
  • A.informs Department members of the pertinent provisions of the Charitable Games Act, Chapter 230, Act 30 of the Illinois Compiled Statues.
  • B.informs Department members of an amendment to the Charitable Games Act by allowing qualified organizations to conduct charitable games.
  • C.provides procedures for notification to affected units when the Department has been informed that a license has been issued to a qualified organization to conduct charitable games.
  • D.provides procedures for notifying the Illinois Department of Revenue when any action relating to the operation of a charitable game has been taken.

III.Procedures
  • A.The General Counsel to the Superintendent will:
    • 1.receive correspondence from the Illinois Department of Revenue stating that a license has been issued to a qualified organization to conduct charitable games.
    • 2.inform the district commander of the affected district and the Commander, Asset Forfeiture Section of :
      • a.the name of the person as stated on the license;
      • b.the location where the charitable game (s) is to be conducted; and
      • c.the date (s) and time(s) when the charitable game (s) is to be conducted
  • B.Department members conducting a preliminary investigation of a bona fide offense relating to the Charitable Games Act will:
    • 1.submit the appropriate case report and forward one copy of the report to the Chief, Organized Crime Division.
    • 2.request the assignment of a lieutenant, acting lieutenant or member of higher rank from the district of occurrence who will respond and assume responsibility for proper police action and comprehensive reporting.
      NOTE:
      If a lieutenant, acting lieutenant or member of higher rank is not available, the sector / rapid response sergeant will respond.
    • 3.include in the narrative section of the case report:
      • a.The name of the person whose name appears on the charitable games license;
      • b.The charitable games license number;
      • c.The name of the qualified organization sponsoring the game (s) and location as stated on the license.
    • 4.notify the Organized Crime Division, Administrative Group, 24-hour desk personnel and provide a summary of the enforcement action taken and the information outlined in Item III-B-3 of this directive.
  • C.Organized Crime Division 24-hour desk personnel will notify the Deputy Agent, Illinois Department of Revenue that law enforcement action relating to the operation of a charitable game was taken and provide, if requested, the information outlined in Item III- B- 3 of this directive.
  • D.The Organized Crime Division will forward one copy of any report received pursuant to Item III-B-3 of this directive to the Bureau Manager of Criminal Investigations, Illinois Department of Revenue.
  • E.Arrest for violations of the Charitable Games Act (230 ILCS) or gambling (720 ILCS 5/28-1) will be returnable to the appropriate local misdemeanor / ordinance court branch and court call in accordance with provisions of the Department directive entitled "Court Call Schedule."
