Nursing Mothers in the Workplace Act

I.Purpose
This directive informs:
  • A.Department members of the Nursing Mothers in the Workplace Act (Illinois Public Act 92-0068).
  • B.Department members who are nursing mothers of the procedures for obtaining protective clothing for prescribed firearms qualification, practice, or training.
II.Policy
  • A.Female members who are nursing mothers will be provided break / personal time and a private place to express their milk.
  • B.Female sworn members, who are nursing mothers participating in the prescribed firearms qualification, practice, or training will, upon their proper notification consistent with Item IV-B of this directive, be provided with and required to wear protective clothing to prevent lead contamination while firing their weapons on the range.
III.Relevant of Statutes
The Nursing Mothers in the Workplace Act provides:
IV.General Information Regarding Firearms Qualifications, Practice, or Training for Nursing Mothers
  • A.Female sworn Department members, who are nursing mothers participating in the prescribed firearms qualification, practice, or training will be provided with protective clothing by the personnel at the Education and Training Division Range.
  • B.It is the responsibility of the member to notify the Education and Training Division Range personnel that she is a nursing mother prior to participating in the prescribed firearms qualification, practice, or training by following the procedures outlined in Item V of this directive.
V.Procedures for Firearms Qualification, Practice, or Training for Nursing Mothers
  • A.Prior to the sworn Department member discharging a firearm on the range, she will schedule an appointment with the Education and Training Division Range.
  • B.The Education and Training Division Range firearms supervisor or an appointed designee will:
    • 1.schedule an appointment with the Department member during her regular working hours to fulfill the prescribed firearms qualification, practice, or training.
      NOTE:
      Overtime compensation will not be approved for the member to participate in the prescribed firearms qualification, practice, or training.
    • 2.provide the prescribed protective clothing to the member prior to the member entering the firing line of the range.
    • 3.provide the member with instructions for the donning and removal of the protective clothing.
    • 4.assist the member in the proper donning of the protective clothing, if requested.
    • 5.ensure that the member is the only individual on the range at the time the member discharges a firearm on the range.
    • 6.assist the member in the proper removal and disposal of the protective clothing, if requested.
VI.Unit Responsibilities
The commanding officer of each district, unit, or facility will provide a private location within the district, unit, or facility and will ensure that break/personal time is allowed for the nursing mother to express her milk in accordance with Item III of this directive.
