Alternative Search Warrant Approval Method

I.Purpose
This directive continues an alternate search warrant approval method to allow facsimile (fax) approval of search warrants by a Cook County Assistant States Attorney (CCASA).
II.Scope
Facsimile CCASA approval is limited to narcotics-related and gambling-related search warrants.
III.Search Warrant Compliant Preparation
When a narcotics-related or gambling-related search warrant is sought:
  • A.the sworn member will prepare one original Complaint for Search Warrant (CCMC-1-219) and one original Search Warrant (CCMC-1-220) and follow the provisions set forth in Items VI-A-2 and VI-A-3 of the Department directive entitled "Search Warrant and Consent to Search Incidents."
  • B.the unit commanding officer or designated unit supervisor the rank of lieutenant or above will ensure that submissions are complete and follow the guidelines set forth in Items VI-B-1 through VI-B-5 of the Department directive entitled "Search Warrant and Consent to Search Incidents."
  • C.the unit commanding officer or designated unit supervisor the rank of lieutenant or above will indicate approval by initialing with star number and recording the date of approval and deconfliction number in the lower-left margin of the face side of each original document.
IV.Search Warrant Approval
  • A.The sworn member seeking to obtain a search warrant that is:
    • 1.gambling-related will contact the  Felony Review Unit to initiate all requests.
    • 2.narcotics-related will:
      • a.contact the  Narcotics Prosecutions Bureau to initiate requests between 0900 hours and 1700 hours, on regular court days;
      • b.contact the  Felony Review Unit at all other times.
  • B.Once contacted by a CCASA, the sworn member will be given a fax number to fax the Complaint for Search Warrant and Search Warrant.
    NOTE:
    The submitting sworn member is required to verify that the fax machine being used has the correct date and time. The only fax machines allowed for these transactions must be under the control of the CCASA offices and those within Chicago Police Department facilities.
  • C.The on-duty CCASA will then review the documents for approval.
    NOTE:
    If the CCASA deems it necessary to meet with the sworn member in person for consultation and review of documents, the sworn member will relocate to the office of the CCASA as directed.
  • D.After approval, the reviewing CCASA will sign the documents provided by the submitting sworn member, inserting the search warrant number, and date.
  • E.The reviewing CCASA will then fax the approved Complaint for Search Warrant and Search Warrant to the submitting sworn member. The approved facsimile with the reviewing CCASA original signature will be retained by the Cook County State's Attorney's Office.
  • F.The sworn member will then print in the left margin on the face side of the original pre-faxed documents the approving CCASA name, the search warrant number, and date.
  • G.The sworn member will present both the original documents and the faxed CCASA approved copies of the Complaint for Search Warrant and Search Warrant to a judge for approval. The judges signature will be required only on the original pre-faxed documents.
    NOTE:
    This set of Complaint for Search Warrant and Search Warrant, with the judges signature, will serve as the required court documents.
  • H.The requesting sworn member will:
    • 1.ensure the approving judge has entered the date and time on the original documents;
    • 2.print the name of the approving judge in the lower-right margin on the face side of both original pre-faxed documents; and
    • 3.prepare one copy of the Complaint for Search Warrant and two copies of the Search Warrant.
  • I.The facsimile documents with the approving CCASA signature will be filed in the unit search warrant file, in addition to those required in Item XI-A-2-b of the Department directive entitled "Search Warrant and Consent to Search Incidents."
V.Procedures
Upon completion of the Alternate Search Warrant Approval Method detailed in this directive, all subsequent search warrant execution and processing procedures will follow the requirements outlined in the Department directive entitled "Search Warrant and Consent to Search Incidents."
