I.Purpose
This directive outlines Department procedures for investigating crashes on the waterways within the jurisdiction of the City of Chicago.
II.Policy
The investigation of crashes on the waterways within the jurisdiction of the City of Chicago will be expeditiously completed in order to minimize delay.
III.General Information
  • A.The State of Illinois Conservation Police have overall responsibility of investigating accidents on the waterways within the State of Illinois.
  • B.When the State of Illinois Conservation Police are unable to respond to a crash on the waterway within the jurisdiction of the City of Chicago, a member from the Chicago Police Department’s Marine Unit will investigate the incident.
IV.Responsibilities and Procedures
  • A.Department member investigating a crash on a waterway within the City of Chicago will:
    • 1.if there is a person injured on scene, ensure emergency medical treatment, transport the injured to shore, and request assignment of Chicago Fire Department personnel.
    • 2.if the vessels involved can be safely operated or require a tow, remove the vessel to the closest secure mooring.
      NOTE:
      If the vessel(s) must be towed, the investigating officer will complete a CPD Marine Unit Voucher (CPD-21-447).
    • 3.conduct a thorough preliminary investigation into the cause of the crash.
    • 4.in cases of suspected alcohol or drug use, follow the procedures consistent with the Department directive entitled “Driving While Under The Influence (DUI) and Zero Tolerance.”
    • 5.document the crash on a CPD Boat Accident Investigation Report (CPD-21-456).
    • 6.preserve and inventory all evidence as delineated in Department Directives.
    • 7.mark scenes involving break walls, piers, or shores for identification by follow-up investigators.
    • 8.inform the persons involved they must report the crash to the Illinois Conservation Police within five days for a Department of Natural Resources Law Enforcement Boating Accident Report (IL-422-0074).
      NOTE:
      If a death has occurred, the report must be submitted within forty-eight hours.
    • 9.if a determination of fault can be made, issue the appropriate citation.
    • 10.ensure notifications are made to:
      • a.the Illinois Conservation Police of the crash date, time, location, and CPD RD number.
      • b.the United States Coast Guard for all crashes involving commercial vessels.
        NOTE:
        All notifications will be made by Marine Unit desk personnel.
  • B.Persons that call to report an accident on the waterway and are no longer on the scene will be advised to contact the  Illinois Conservation Police .
