Enforcement of the Chicago Cruising Zones

I.Purpose
This directive:
  • A.informs Department members of the Chicago Cruising Zones Ordinance, Sections 9-80-210 through 214 of the Municipal Code of Chicago.
  • B.defines terms pertinent to the enforcement of the Chicago Cruising Zones Ordinance.
  • C.continues the Chicago Cruising Zones Ordinance - Written Notice (CPD-21.626).
  • D.continues the Departments response and enforcement procedures to substantiate a violation of the Chicago Cruising Zones Ordinance.
  • E.instructs Department members to utilize the Administrative Notice of Ordinance Violation (ANOV) citation to cite violations of the Chicago Cruising Zones Ordinance.

III.General Information
  • A.The objective of the Chicago Cruising Zones Ordinance is to reduce chronic traffic problems sustained by motorists in an area where cruising may result in congested traffic.
  • B.The Chicago Cruising Zones Ordinance - Written Notice (CPD-21.626) will be used to notify any person operating a motor vehicle in a designated no cruising zone that a third passage past that traffic control point as a driver or a passenger of a vehicle within the same one-hour period shall constitute a violation of this ordinance.
  • C.The following information is provided to clarify the intended application of the Chicago Cruising Zones Ordinance and establish a uniform method of enforcement:
    • 1.Areas within the city have been designated as "No Cruising Zones" and are identified by the posting of signs describing the violation.
    • 2.Enforcement actions against a motorist are not limited to application of this ordinance. If a sworn member discovers that a motorist is otherwise engaged in other unlawful conduct, the appropriate enforcement action will be taken.
IV.Procedures
  • A.Sworn Department members will:
    • 1.be consciously aware of the locations of and the motor vehicles passing through the designated "No Cruising Zones."
    • 2.attempt to establish if circumstances are present which provide some reasonable and lawful explanation for repetitive driving of a motor vehicle in the designated "No Cruising Zones."
  • B.If a sworn Department member observes a person operating a motor vehicle that has passed through a designated no cruising zone and the member reasonably believes that the operator of that motor vehicle is cruising, the member will:
    • 1.on the second passage within a one-hour period, safely initiate and conduct a traffic stop as outlined by existing Department procedures and training.
    • 2.verbally inform the motorist that his or her vehicle has previously been observed passing a traffic control point located in a no cruising zone, specifying the time that the vehicle was initially observed passing the traffic control point.
    • 3.complete Chicago Cruising Zones Ordinance - Written Notice. The original will be issued to the motorist and the copy attached to the completed TSSS-DIC.
    • 4.document the traffic stop by completing a Traffic Stop Statistical Study - Driver Information Card (TSSS-DIC) (CPD-21.103) following the procedures outlined in the Department directive entitled "Illinois Traffic Stop Statistical Study." Department members will indicate:
      • a.both the time of the initial observation cited in Item IV-B-2 of this directive and the time of the initial traffic stop in the Date / Time of Stop section of the TSSS-DIC.
      • b.that the subject was stopped and issued the Chicago Cruising Zones Ordinance-Written Notice, MCC 9-80-211 by checking the box designated "MCC" and by writing "9-80-211 – WARN" in the "violation" section of the TSSS-DIC.
    • 5.verbally inform the motorist that a third passage of the traffic control point within one-hour of the time of the initial observation cited in Item IV-B-2, even as a passenger in a vehicle, will be a violation of this ordinance and subject to enforcement action.
  • C.If a third passage is observed within the same one-hour period of the initial observation constituting a violation of the Chicago Cruising Zones Ordinance, the Department member will:
    • 1.safely initiate and conduct a traffic stop as outlined by existing Department procedures and training.
    • 2.issue the violator an ANOV citation, following the procedures outlined in the Department directive entitled "Municipal Administrative Hearings"and indicate:
      • a.the Municipal Code of Chicago violation 9-80-212 in the OTHER: TITLE CHA. SEC. section of the ANOV citation.
      • b."Cruising Zones – Violation" in the Offense section of the ANOV citation.
    • 3.document the traffic stop and issuance of the ANOV citation by completing a TSSS-DIC following the procedures outlined in the Department directive entitled "Illinois Traffic Stop Statistical Study." Department members will indicate that the subject was stopped for a Chicago Cruising Zones Ordinance - Violation, MCC 9-80-212 by checking the box designated "MCC" and by writing "9-80-212 – ANOV" in the violation section of the TSSS-DIC.
      NOTE: No TSSS citation sticker will be applied to the ANOV.
    • 4.cross-reference the control numbers from the TSSS-DICs completed in Items IV-B-4 and IV-C-3 of this directive in the Comments section of the ANOV citation.
    • 5.paperclip a photocopy of both corresponding TSSS-DICs and a copy of Chicago Cruising Zones Ordinance - Written Notice to the "Department of Administrative Hearing Copy" of the ANOV citation.
    • 6.submit the completed:
    • 7.if the driver and/or passengers of the vehicle are otherwise observed engaging in other unlawful conduct, take the appropriate enforcement action consistent with current Department procedures and training. (e.g. issuance of Personal Service or Violation Notice citations.)
  • D.If a third passage is not observed within the same one-hour period of the initial observation, the member will submit the TSSS-DIC from the second observation, with the attached copy of the Chicago Cruising Zones Ordinance - Written Notice, as outlined in the Department directive entitled "Illinois Traffic Stop Statistical Study."
  • E.Citation clerks and unit members designated to process ANOV citations will:
    • 1.ensure a photocopy of both corresponding TSSS-DICs and Chicago Cruising Zones Ordinance - Written Notice completed pursuant to the enforcement of the Chicago Cruising Zones Ordinance are attached to the "Department of Administrative Hearing Copy" of the ANOV citation.
    • 2.process the completed ANOV citations as outlined in the Department directive entitled "Municipal Administrative Hearings."
V.Supervisory Responsibilities
  • A.District commanders whose districts encompass areas that are designated as no cruising zones will:
    • 1.monitor and evaluate the enforcement of this ordinance.
    • 2.coordinate enforcement efforts when designated no cruising zones border or overlap district boundaries.
