I.Purpose
The purpose of this directive is to inform Department members of the need to pay particular attention to Section 43-1 of the Municipal Code of Chicago, and to report apparent violations of this ordinance to the Commissioner, Inspectional Services.
II.Enforcement
  • A.Sworn Members
    When a sworn member becomes aware of the enlargement, erection, alteration, repair, or removal of any building or if any other type of work is commenced as outlined in ordinance 43-1, and the permit for such work is not posted, or the permit is not posted in a conspicuous place, the member will require the person in charge of such work to exhibit his permit and post it in a conspicuous place. If the person in charge of such work does not have a permit or refuses to exhibit it, the member will direct that all work be stopped.
    • 1.The sworn member will immediately notify the desk sergeant in the district of occurrence. The desk sergeant will enter the relevant information (date, time, location and name(s) of the individual(s) contacted at the work site) for the utilization by oncoming watch personnel in the Commanding Officers Book.
    • 2.The desk sergeant will notify the  Deputy or Assistant Commissioner of Inspectional Services , Monday through Friday, between the hours of 0830 and 1630, by telephone. The date, time, and name of the individual notified will be recorded in the Commanding Officers Book.
  • B.Commissioner, Inspectional Services Office
    The Commissioner, Inspectional Services Office, pursuant to Section 43-1 as stated in Item II, will conduct inspections when notified by the Department or through the offices internal procedures.
    • 1.When a violation of Section 43-1 of the Municipal Code of Chicago has occurred, the Commissioner, Inspectional Services Office will notify the Department that the work at such location is to be stopped. The beat officer will notify a responsible person at the site of the violation to stop and keep stopped all work being performed in violated of the ordinance.
    • 2.During subsequent tours of duty, officers will make certain that the work is not resumed until a resumption order has been received from the Commissioner, Inspectional Services.
      NOTE:
      If for any reason the person(s) in charge of a work site refuses to comply with a stop order issued by the Commissioner, Inspectional Services, enforcement action will be taken. In addition, the officer will request that the desk sergeant notify the Deputy or Assistant Commissioner, Inspectional Services as outlined in Item II-A-2. If a notification is necessary after 1630 and before 0830 hours Monday through Friday or at any time of the day on Saturdays, Sundays, or holidays, the desk sergeant will request that the Deputy or Assistant Commissioner, Inspectional Services be notified of the non-compliance with the stop order. The date, time, and name of the individual notified will also be recorded in the Commanding Officers Book.
