| I. | Purpose |
| A. | continues procedures relating to seized or unclaimed property which may be available for Department use from the Evidence and Recovered Property Section in lieu of purchasing a similar item. |
| B. | revises procedures for requesting expropriated vehicles from the Automotive Pounds Section for Department use. |
| II. | Seized/Unclaimed Property |
| A. | When sized or unclaimed property in the possession of the Evidence and Recovered Property section has been released by the courts or has become Department property and cannot be returned to the owner, the Commanding Officer, Evidence and Recovered Property Section will notify the Commanding Officer, Equipment and Supplies Section of any item that may be of use to the Department. |
| B. | When the Commanding Officer, Equipment and Supplies Section determines that an item is of potential use to the Department and meets Department specifications, he will notify the Commanding Officer, Evidence and Recovered Property Section and request that the item be transferred to the Equipment and Supplies Section inventory. The Commanding Officer, Equipment and Supplies Section will then allocate the item to the unit that will use the item or place it in stock to be allocated according to the Department procedures. |
| C. | When a unit commanding officer determines that equipment not normally supplied by the Department is required and will have to be purchased, he will submit a To-From-Subject report, fully explaining the need for such and item, through channels to the Deputy Superintendent, Bureau of Administrative Services, Attention: Commanding Officer, Equipment and Supplies Section and the Evidence and Recovered Property Section. |
| D. | The Commanding Officer, Equipment and Supplies Section will ascertain if the item is available. If the item requested is: |
| 1. | not available, he will notify the requesting unit of the availability of the requested item. |
| 2. | available, he will complete a Request for Unclaimed Property form (CPD-34-.502) and forward it to the command staff member of the General Support Division, for his approval. |
| E. | The command staff member of the General Support Division will notify the requesting unit if the request is disapproved. If the request is approved, the item requested will be turned over to the requesting unit. The Commanding Officer, Equipment and Supplies Section will decide whether an item turned over to unit for Department use will be added to the receiving unit’s inventory. |
| F. | When an item is no longer needed by a unit or if it is no longer in serviceable condition, the item will be returned to the Equipment and Supplies Section for reissuance of disposal. |
| III. | Expropriated Vehicles |
| A. | The Fleet Liaison Office will be notified by the Commanding Officer, Auto Pounds Section whenever a vehicle, in good condition, in the possession of the Automotive Pounds Section is scheduled to be disposed of according to the law. |
| B. | The Fleet Liaison Office will then assign a member of his command to determine if any such vehicle is suitable for Department use. After the vehicle is inspected, the Automotive Pounds Section will be notified of any vehicle that is deemed suitable and which vehicle should be disposed of according to the Department procedures. |
| C. | When the Fleet Liaison Office determines that a particular vehicle meets Department requirements and guideline, the Fleet Liaison will complete a Request for Unclaimed Property form for each vehicle, giving a complete description of the vehicle which will include the year, make, model, odometer reading, condition of vehicle, the Pound and Motor Vehicle Inventory Number of the Vehicle and will forward the completed form to the command staff member of the General Support Division. |
| D. | The command staff member of the General Support Division will: |
| 1. | approve the request and submit it to the Deputy Superintendent, Bureau of Administrative services for approval, or |
| 2. | disapprove the request and notify the Automotive Pounds Section to dispose the Vehicle according to the Department procedures. |
| E. | Upon approval by the Deputy Superintendent, Bureau of Administrative Services, the command staff member of the General Support Division will request that the Commanding Officer, Automotive Pounds Section turn the Vehicle over to the Fleet Liaison Office. |
| F. | When such a vehicle is turned over to the Fleet Liaison Office it will be placed in the Department motor pool and allocated according to the Department procedures. |
