Enforcement of Bicycle Messenger Ordinance

I.Purpose
The City Council has passed an ordinance regulating bicycle messenger services. This ordinance became effective 29 October 1992 and requires any person engaged in the operation of a bicycle messenger service and any person employed as a bicycle messenger to comply with the provisions of Chapter 4-34 of the Municipal Code of Chicago.
II.Responsibilities
  • A.Members will issue an Ordinance Complaint form in accordance with the applicable provisions of the Department directive entitled “Ordinance Complaint Form” to a licensed operator of a bicycle messenger service for violation of:
    • 1.Section 4-168-070 (a) when the licensee fails to supply each bicycle operator with a safety helmet, and safety vest or other garment, displaying the name of the licensee.
    • 2.Section 4-168-080(a) when the licensee fails to supply each bicycle operator with an identification card containing the:
      • a.bicycle operator’s name;
      • b.bicycle operator’s identification number;
      • c.licensee’s name, business address, telephone number and bicycle messenger service license number;
      • d.name of the insurance company that has issued the insurance policy and policy number;
      • e.a clear photograph of the bicycle operator
  • B.Members will issue an Ordinance Complaint form to the bicycle operator for violation of:
    • 1.Section 4-168-070 (b) for failure to:
      • a.wear a safety helmet;
      • b.wear a safety vest or other garment of a bright color, prominently displaying the name of the license and permitting identification of the bicycle operator;
      • c.display required identification numbers and or letters on the bicycle.
    • 2.Section 4-168-080 (b) for failure to carry on his person an identification card in accordance with the requirements of Section 4-168-080(a).
  • C.Members will issue Personal Service traffic citations to bicycle operators in violation of the traffic laws and ordinances as they apply to bicycle messenger operators.
