I.Purpose
This directive:
  • A.describes the distribution of completed Arrest Reports (CPD-11.420).
  • B.defines responsibility for disseminating Court Complaint Transmittal Listings.
  • C.assigns certain Department members to specific duties when preparing documents for court.
II.CLEAR Automated Arrest Report
Department members will refer to the Department directive entitled "CLEAR Automated Arrest System" when distributing an Arrest Report or related documents created using the automated system.
III.Paper Arrest Report
Paper Arrest Reports are to be used only when the system is down and authorization is obtained by a Bureau of Patrol Deputy Chief, or member of higher rank as outlined in the Department directive entitled "Alternate Paper Reporting Procedures."
  • A.After the Arrest Report has been properly completed, desk personnel will distribute the report and copies as described below.
  • B.The Permanent Record-Records Division (PR-RD) copy (white) will be sent to the Identification Section after the arrestee has been sent to court, released, or released without charging.
    NOTE:
    The original Arrestee Medical Clearance Report (CPD-11.524), if any, will be attached to the Permanent Record-Records Division copy and sent to the Records Division.
  • C.Once the system is restored, information will be manually entered by the district station personnel.
IV.Court Complaint Transmittal Listing
  • A.First watch station supervisors are responsible for assembling court papers and preparing separate Court Complaint Transmittal Listings (CPD-11.551) for each court call, in each court branch, for all arrestees sent to court via the first prisoner transfer van pickup. In addition, first watch station supervisors are responsible for assembling court papers and the preparation of separate Court Complaint Transmittal Listings for each court call in each court branch for all arrestees let to bail and for sending the documents to the appropriate court on a daily basis (excluding weekends and holidays). Department members will refer to the form entitled "Checklist for Required Documents for Prisoner Transfer to Cook County Sheriff Personnel (CPD-34.441)."
  • B.Second watch station supervisors are responsible for assembling court papers and the preparation of separate Court Complaint Transmittal Listings for each court call, in each court branch, for all arrestees sent to any court after the first prisoner transfer van pickup each day.
V.PREPARATION OF REQUIRED COURT DOCUMENTS
The following list of documents will be separated into subsections, stapled when applicable, all four packets rubber-banded together, and placed in the following order:

  • A.Desk personnel preparing court papers for transmittal to the appropriate courts will use staples to secure and prepare the documents, when applicable, as listed below:
    • 1.Court Copies of the Arrest Report:
      • a.Three copies for arrestees appearing at 2600 South California.
      • b.Two copies for arrestees appearing at courts other than 2600 South California.
    • 2.The first ten pages of the arrestees' Criminal History Report for the Sheriff's Office and one complete copy of the arrestees’ Criminal History Report or No Record Notification and Final Disposition Report for the State's Attorneys Office;
    • 3.Copy of the case report, if applicable;
    • 4.Felony Minute Sheet, if applicable;
    • 5.Transport copy of the Arrest Report when let to bail;
    • 6.Court copy of the bail bond, if applicable;
    • 7.Court copy of the Property Inventory, if applicable;
    • 8.Criminal complaints, if applicable;
    • 9.Warrant-specific documents as outlined below:
      • a.Chicago Warrants
        One copy of the computer printout from the Chicago Database (HOT DESK) and the faxed warrant from the Central Warrants Unit, Field Services Section, Records Division.
      • b.LEADS Warrants Within Cook County
        One copy of the LEADS printout including the originating agency (ORA) information and warrant affidavit from the Department extradition officer, as delineated in the Department directive entitled “Non-Traffic Arrest Warrant Procedures.”
      • c.LEADS Warrants (warrants outside Cook County, but within Illinois)
        One copy of the LEADS printout, including the originating agency (ORA) information, and the warrant affidavit from the Department extradition officer, as delineated in the Department directive entitled “Non-Traffic Arrest Warrant Procedures.”
      • d.Out-of-State Warrants
        One copy of the National Crime Information Center (NCIC) printout, including the originating agency (ORA) information, and the SAO sheet from the Department extradition officer, as delineated in the Department directive entitled “Extradition Procedures.”
        NOTE:
        A copy of the printout from the NCIC database is not required to accompany the court papers only if preparing members have obtained the SAO sheet from the Department extradition officer.
      • e.United States Government Warrants
        Detainer or Warrant from the governmental agency and one printout from the NCIC computer database.
      NOTE:
      The following warrants are never sent to Cook County Branch Courts unless there are local charges: Government Warrants, Cook County Child Support (must be picked up and taken to Daley Center only), and IDOC warrants.
    • 10.Hospital/Medical Clearance, if applicable, must be signed by a doctor.
  • B.All court documents will accompany arrestees being transported to court and will be delivered by the transporting officers to the Cook County deputy sheriff receiving the arrestees.
  • C.All court documents for arrestees who have been let to bail will be sent to the appropriate court via Department mail.
  • D.Station supervisors responsible for the preparation of court documents will ensure:
    • 1.that a copy of the arrestee's Criminal History Sheet or No Record Notification (for all arrestees who have been fingerprinted) is attached.
    • 2.that the Identification Record (IR) number on the arrestee's Criminal History Sheet is accurately recorded on the Arrest Report and the Court Complaint Transmittal Listing.
    • 3.that the completion of the Arrest Warrant Execution Verification (CCG0657) form is included with the documents that comprise the court package for this arrest.
