I.Purpose
This directive:
  • A.outlines policy and procedures concerning the physical restraint of persons in Department custody.
  • B.authorizes the use of disposable flexible restraining devices (flex cuffs), handcuffs, and leg irons.
  • C.continues the policy for the use of Department leg irons during arrestee transfers.
  • D.provides general guidelines relating to the use of restraining devices.
  • E.outlines Department policy regarding custodial and transport searches.
  • F.satisfies CALEA Law Enforcement Standards in Chapters 1 and 70.
II.Policy
Department members are responsible for the safety and security of persons in their custody. A person taken into Department custody will be searched prior to transport and restrained in such a manner as to prevent escape and to provide for the safety of the public, the person in custody, and the officers involved.
III.Requirements
  • A.Any sworn member whose date of appointment is after 1 December 1991 is required to own and carry Department-approved handcuffs.
  • B.On-duty sworn members are required to carry authorized handcuffs when their duty assignments involve field law-enforcement activities.
  • C.On-duty sworn members not normally assigned to field activities may be exempted from the requirement to carry handcuffs on their person at the discretion of their respective exempt commanding officer.
  • D.Sworn members,even when not required, may at their discretion carry handcuffs consistent with the Department directive entitled "Personal Appearance, Uniform/Citizen's Dress and Equipment."
IV.Custodial Searches Involving Arrestees
  • A.A custodial search is a warrantless search of a person under arrest with or without probable cause to believe there is any contraband or evidence subject to seizure on the person. This type of search is justified by the need to keep contraband and weapons out of jail, to preserve any possible evidence, and to protect the officer. [Chimel v. California, 395 U.S. 752 (1969); New York v. Belton, 453 U.S. 454 (1981)].
  • B.Department members taking persons into custody or accepting custody from other Department members will be responsible for conducting a thorough search and ensuring that the persons are appropriately restrained to prevent escape or injury.
    NOTE:
    Department members conducting subsequent required custodial searches during multiple-arrest situations are cautioned that the preliminary search may, due to urgent circumstances, have been limited or not fully effective.
  • C.Custodial searches will be conducted by a member who is the same gender as the arrestee; however, if a member of the same gender is not immediately available and officer or citizen safety is compromised absent an immediate search, members will not endanger themselves or the public to comply with this requirement.
V.Use of Restraining Devices
  • A.Handcuff Use
    • 1.When feasible, an arrestee will be handcuffed with both hands behind the back and palms positioned outward. Handcuffs will be double-locked.
      NOTE:
      When restraining an arrestee with a flexible restraining device, members will, when feasible, employ the same method of hand positioning (both hands behind the back, palms out).
    • 2.An arrestee taken into custody will be handcuffed unless:
      • a.the arrestee is injured to the extent that he or she is incapable of offering resistance or the process of handcuffing could inflict additional physical trauma to the arrestee.
      • b.physical characteristics (e.g., size, missing limbs) of the arrestee hamper the use of handcuffs.
        NOTE:
        The fact that an arrestee is physically disabled does not preclude the use of restraining devices (handcuffs, stretcher restraining straps, flexible restraining devices, leg irons).
      • c.handcuffing the arrestee would be an excessive measure of restraint (e.g., the arrestee's age, physical health, or condition).
      • d.remove restraining devices immediately prior to securing the prisoner within a holding cell area unless there is a risk to security or safety
      • e.being held for investigation in an area Bureau of Detectives facility except when, at the discretion of the Bureau of Detectives watch coordinator, handcuffing is required to ensure appropriate security.
    • 3.When there is a likelihood of a multiple-arrest situation, flexible restraining devices may be issued.
  • B.Removal From Secured Facility - Additional Restraint
    • 1.All arrestees removed from a secured Department lockup facility will be restrained in accordance with this directive.
      NOTE:
      The provisions set forth for the application of leg irons do not apply to persons brought into the lockup facility solely for the purposes of fingerprinting or photographing.
    • 2.Members will comply with the Department directive entitled "Processing Persons Under Department Control" when removing an arrestee from a Department lockup facility.
      • a.After being authorized to make the removal, the member will:
        • (1)be issued Department leg irons by lockup personnel consistent with the Department directive entitled "Department-Issued Restraining Devices."
        • (2)record the issuance of leg irons on the Leg Iron Control Sheet.
      • b.Prior to removing the arrestee from the lockup, the responsible member will:
        • (1)handcuff the arrestee in the manner detailed in Item V-A of this directive.
        • (2)apply the leg irons above the ankles of the arrestee.
      NOTE:
      The responsible member may remove the leg irons after the arrestee has been placed in a secure area of a Department facility and is being monitored in accordance with existing directives.
    • 3.During a removal of an arrestee(s), the responsible member may exercise discretion in applying the leg irons to the arrestee(s) when:
      • a.such application would interfere with the provision of emergency medical treatment.
      • b.the expedient removal of arrestees from the detention facility is required due to an emergency.
        NOTE:
        In such cases, the responsible member will have leg irons available to be applied to the arrestee(s) when circumstances allow for their application.
      • c.the arrestee is injured to the extent that he or she is incapable of offering resistance or the process of applying leg irons could inflict additional physical trauma to the arrestee.
      • d.the arrestee has physical characteristics (e.g., size, missing limbs) that hamper the use of leg irons.
      • e.applying leg irons would be an excessive measure of restraint (e.g., the arrestee's age, physical health, or condition).
      • f.a cooperative arrestee is being removed from the lockup.
      NOTE:
      Department members will notify their immediate supervisor when leg irons are not used.
  • C.Arrestee Transport
    • 1.Department members will search all arrestees prior to transport, in accordance with established Department procedures.
    • 2.Department members will not interrupt an arrestee transport without exigent circumstances requiring immediate action by the members and minimal risk to the arrestee.
    • 3.When an arrestee is to be transported to another location (hospital, court facility, etc.) by other than prisoner transfer van personnel, the responsible member will comply with Item V-B of this directive.
      • a.An arrestee will not normally be transported in a passenger vehicle not equipped with a protective divider.
      • b.Two officers will be assigned when transporting an arrestee.
    • 4.The Commanding Officer, Central Detention, will submit for the approval of the Chief, Bureau of Patrol, a written policy governing the use of restraining devices by prisoner transfer van personnel.
    • 5.Any sworn member responsible for the movement of an arrestee, in addition to the required custodial search, will be responsible for searches of all places the arrestee will have access to, both prior to and after the arrestee has been placed in the area. The search of the area will ensure the arrestee is not able to access or discard any prohibited items. Areas to be searched include, but are not limited to:
      • a.hospital treatment areas;
      • b.rooms in Department facilities (interview rooms, office areas, holding areas, etc.); and
      • c.Department vehicles.
    • 6.Before and after each transport, officers assigned to a Department vehicle will be responsible for inspecting the passenger compartment for the presence of any unauthorized items (weapons, lost/mislaid property, contraband, etc.).
    • 7.When practicable, arrestees will be kept under constant observation during transport.
  • D.Department members engaged in the application or use of authorized restraining devices are reminded of the dangers involved with positional asphyxia. Under no circumstances will a person being restrained have their arms and legs secured together in a fashion commonly known as "hog-tying."
