Illinois Firearm Owner's Identification Card or Concealed Carry License Revocation

I.Purpose
This directive:
  • A.delineates procedures for receiving Illinois Firearm Owner's Identification (FOID) cards or Concealed Carry Licenses (CCL) that have been revoked by the Illinois State Police.
  • B.introduces the Illinois State Police Firearm Disposition Record (ISP 2-636) available on the Department Directives System.
II.General Information
  • A.Pursuant to 430 ILCS 65/9.5, the Illinois State Police (ISP) is authorized to issue a FOID revocation notice requiring the person receiving the notification to complete an Illinois State Police Disposition Record and surrender both the form and the FOID card to the local law enforcement agency within 48 hours of receiving the notification.
  • B.Pursuant to 430 ILCS 66/70(g), a CCL licensee whose license is revoked, suspended, or denied shall, within 48 hours of receiving notice of the revocation, suspension, or denial, surrender his or her concealed carry license to the local law enforcement agency where the person resides. The local law enforcement agency shall provide the licensee a receipt and transmit the concealed carry license to the Department of State Police.
  • C.Department members will not direct the individual to an ISP facility.
  • D.Department members will not inventory the surrendered FOID cards or CCL Licenses.
III.Procedures
  • A.District desk personnel receiving a revoked FOID card will:
    • 1.accept the surrendered FOID card;
    • 2.ensure the person issued the FOID card completes and signs an Illinois State Police Firearm Disposition Record;
      NOTE:
      If the person does not have the form, the officer will provide one by accessing the Department Directives System.
    • 3.sign and date the form in the appropriate fields;
    • 4.make one copy of the form and distribute as follows:
      • a.The copy will be provided to the person surrendering the FOID card and will act as a receipt;
      • b.The receiving officer will place the original form, along with the surrendered FOID card, into a plain white envelope, seal it, address it as indicated below, and forward it to the Police Document Services Section for delivery to the ISP:

    • 5.complete a General Offense Case Report in AIRA using the following IUCR classifications:
      • a.Primary box: Non-Criminal
      • b.Secondary box: FOID Revocation
      • c.IUCR code: 5114.
      NOTE:
      The Department member completing the report will indicate in the narrative section that a copy of the Illinois State Police Firearm Disposition Record was given to the person surrendering the FOID card and a copy of the form and the surrendered FOID card was forwarded to the Police Document Section to be delivered to the Illinois State Police.
  • B.District desk personnel receiving a revoked CCL License will:
    • 1.accept the surrendered CCL License;
    • 2.place the surrendered CCL License, into a plain white envelope, seal it, address it as indicated below, and forward it to the Police Document Section for delivery to the ISP:

    • 3.complete a General Offense Case Report in AIRA using the following IUCR classifications:
      • a.Primary box: Non-Criminal
      • b.Secondary box: CCL Revocation
      • c.IUCR code: 1481.
      NOTE:
      The Department member completing the report will indicate in the narrative section that the surrendered CCL License was forwarded to the Police Document Section to be delivered to the Illinois State Police.
    • 4.provide the person issued the CCL License with a Victim Information Notice (VIN) containing the Records Division (RD) number of the case report. The VIN will act as a receipt for the surrendered CCL License.
